Introduction

  1. The Cypherverse Ltd. (”TCV”, “we” or “us”) is committed to protecting your privacy. We have prepared this Privacy Policy to describe our practices regarding Personal Data (defined below) we collect, use and share in connection with the services we provide, including our projects hosted at voxodeus.io and cdlounge.io (the “Websites”).
  2. By accessing and using our Services, you agree that you have read and understood, and accept and agree to comply with this Privacy Policy (as amended from time to time).
  3. In this Privacy Policy:
    1. NFT” refers to a non-fungible token or similar digital item implemented on a blockchain (such as the Ethereum and Solana networks); and
    2. Voxo” refers to an NFT belonging to the collection of 6,312 unique digital 3D models, designed and provided by TCV, each represented by an NFT on the Ethereum network.
    3. Lounger” refers to an NFT belonging to the Cosmic Dream Lounge collection of unique PFP (profile prictures), designed by TCV, each represented by an NFT on the Solana network.

Data We Collect

  1. Personal Data” means data that can be used to identify you individually, such as your name, email address, as well as any other non-public information about you that is associated with or linked to the same. “Anonymous Data” means data, including aggregated and de-identified data, that is not associated with or linked to your Personal Data, and does not by itself allow the identification of individual person(s). We collect Personal Data and Anonymous Data (together, “Data”), as described in this Privacy Policy.
  2. Information You Provide Us.
    1. When you use our Services, create, login or update an account profile, interact with or contact us or any other third party, we may collect Personal Data from you, such as any email address(es), first and last name(s), username(s), and any other information you provide. We may also collect your wallet address(es) or other blockchain address(es), which may be or may become associated with Personal Data.
    2. When you contact us or provide us with feedback via email(s) or any other channels, we will collect your name, email address, username and/or public handle, as well as any other content included in the email(s) and/or message(s).
    3. When you connect to our Services via a service provider that uniquely identifies your device, we may receive identification data and use it to offer extended service(s) and/or functionality.
    4. We may collect other types of Personal Data such as your operating system and product registration number.
    5. Our Service(s may allow you to store preferences as to communication method(s) and format(s), on-site notification setting(s), how content shall be displayed, etc. We may associate these preferences with your wallet address(es), browser, device and/or any other identifier, including Anonymous Data or Personal Data.
    6. We may also collect Personal or Anonymous Data at other points in our Services that state that Personal or Anonymous Data, as the case may be, may or shall be collected.
  3. Information Collected via Technology. This type of data may be collected as you navigate through and interact with our Services. Automatic data collection technologies may be engaged to collect certain information about your equipment, internet browsing actions and patterns, including:
    1. To enable and/or potentially improve our Services, we (and/or third party service provider(s)) may collect information from you, including: your browser type, operating system, internet protocol address (”IP Address”, a number that is automatically assigned when you access the internet and may vary from time to time), mobile device ID, blockchain address, wallet type and/or date and/or time stamps.
    2. Like many online websites and applications, we may gather information automatically and store it in log files. Information gathered may include your IP Address, browser type, identification of internet service provider (”ISP”), referring and/or exit pages, operating system, timezone, date and/or time stamps, and clickstream data.
    3. Like many online websites and applications, we may use “Cookies” to collect information. We may use either or both of session cookies (which expire once you quit your web browser) and persistent cookies (which can remain active until you delete them) to analyse how users interact with our Services, to make improvements to our Services and/or to provide users with a more personalised usage experience.
    4. Our systems do not currently recognise “do not track” signals or other mechanisms that might enable users to opt out of tracking on site(s) maintained and/or controlled by us.
    5. Other companies may set their own Cookies, Pixel Tags and/or other tools when you visit their, our or other site(s). This includes third-party analytics services (”Analytics Services”). We may engage companies that own, host and/or are related to Analytics Services, and/or for Analytics Services. Information generated by any Cookies or other technologies about your use of our Services (”Analytics Information”) may be transmitted to Analytics Services. Analytics Services may use Analytics Information to compile reports on user activities, which we may receive on an individual or aggregate basis. We may use the information we receive from Analytics Services to improve our Services. Analytics Services may also transfer information to third parties where required to do so by law or contract, such as where a third party processes Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ terms of use and privacy policy.
  4. Information Collected from Third-Party Companies. We may receive Personal and/or Anonymous Data about you from companies that offer their products and/or services for use in conjunction with our Services or whose products and/or services may be linked from our Services. For example, third-party wallet providers may provide us with your blockchain address and other information you choose to share or allow to be accessible by such wallet providers. We may add this to the data we collect or have already collected from or about you through our Service.
  5. Public Information Observed from Blockchains. We collect data from activity that is publicly visible and/or accessible on blockchains. This may include blockchain addresses and information regarding purchases, sales, transfers,

Use of Data

  1. We use Data when we respond to you, and we may use Data to provide and/or to improve our Services. We may use Data to:
    1. identify and/or verify you as the owner of any NFT(s) including Voxo(s) and Lounger(s);
    2. provide customer or user support;
    3. respond to your enquiries and/or requests;
    4. diagnose and/or fix technological issues, conduct system updates and/or maintenance, ensure the security of our IT systems, architecture and networks;
    5. improve your experience and/or our administration of our Services,
    6. provide you with notifications relating to the Services, including those regarding security, support and maintenance;
    7. investigate and/or address conduct that may constitute abuse or harassment of any person(s);
    8. detect, investigate, prevent and address any fraud, criminal activities, violation(s) of our terms and policies, misuse of our products or services, and/or other harmful or unlawful activities;
    9. provide you with news, offers, surveys and/or other promotional materials or notices related to the Services, TCV, third-parties and/or their goods and services;
    10. analyse trends and track your usage of and interactions with the Services to improve your experience and our service offerings;
    11. monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns;
    12. comply with applicable laws, rules and regulations, respond to requests from public and government authorities, cooperate with law enforcement or other authorities, and/or to consider, pursue or defend against legal threats and/or claims; and
    13. act in any other way we may describe when you provide Personal Data.
  2. We may create Anonymous Data from Personal Data. We may use this Anonymous Data to analyse request and usage patterns so that we may improve our Services. We reserve the right to use Anonymous Data for any purpose and to disclose Anonymous Data to third parties without restriction.

Disclosure of Data

  1. We may disclose your Data as described below and as described elsewhere in this Privacy Policy.
    1. We may share your Data with third party service providers to assist us in pursuing any of the purposes listed in this Privacy Policy as the purposes for which we may use Data. This includes:
      1. : provide or improve technical services (including those relating to security, infrastructure, maintenance and updates), conduct quality assurance testing, analyze how our Service is used, prevent, detect, and respond to unauthorized activities; provide technical and customer support; and/or to provide other support to us and to the Service.
    2. We may share your Data with any subsidiaries, joint ventures, companies or legal entities (whether incorporated or not) that is/are under our control.
    3. We may share Data in connection with or during negotiation of any merger, financing, acquisition, dissolution transaction or proceeding involving any sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of an insolvency, bankruptcy, or receivership, Data may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will possess the Data collected by us and will assume the rights and obligations regarding your Data as described in this Privacy Policy.

Regardless of any choices you make regarding your Data, we may disclose Data if we believe in good faith that such disclosure is necessary: (a) in connection with any legal investigation; (b) to comply with applicable laws, rules or regulations or to respond to subpoenas, warrants, or other legal process involving TCV; (c) to protect or defend TCV’s rights or property or users of the Services; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use.
    5. We may disclose Data to fulfill any purpose(s) for which you provide the Data, for any other purpose disclosed by us when you provide it, or with your consent.
